Design assignment and licensing

Türkiye: practical decision and evidence

Separate assignment of design ownership from a licence permitting specified use. Identify design numbers, parties, territory, duration and permitted activities, then verify the register formalities. A commercial licence does not automatically transfer title to the licensee.

Worked file: a product distributor calls its exclusive licence an ownership transfer. Compare the contract with the registered design numbers, permitted uses and parties. Resolve whether title or merely usage permission changes and complete the relevant register steps; commercial exclusivity alone does not answer ownership.

Individual or company ownership

Choose the applicant according to the intended legal owner, not convenience alone. Record individual or company identity and any assignment arrangements. A shareholder and the company are different persons; rights held personally are not automatically company assets.

Design portfolio management

Build a design portfolio register linking each design to products, owner, country, filing date and renewal event. Reconcile it with official records and licences. A product catalogue alone cannot establish which designs remain registered and who owns them.

Design renewal

Renew each registered design against its filing-date calendar and applicable official renewal conditions; record priority events separately. Check design numbers, ownership and payment evidence. Renewing one product in a portfolio does not renew every related design automatically.

Official filing and support
