Türkiye: practical decision and evidence

Monitor design publications and competing products through images, product names and Locarno classes. Keep dated captures and a comparison log. An alert is a reason to investigate; it neither proves infringement nor stops a competitor’s application automatically.

Worked file: an image alert resembles a protected product but shows only one view. Preserve the source, date and product identifier, seek additional views and check the right’s current status. Escalate a supported comparison; do not send an automatic infringement accusation from the image match alone.

Preliminary design search

Search earlier design publications, product catalogues and dated market disclosures. Compare visible features and overall impressions rather than only product names. A database search with no matching result does not guarantee novelty or individual character.

Opposing a design publication

To oppose a published design, identify the challenged design and substantiate the legal ground with dated earlier material and a visual comparison. File through the correct official procedure within its period. An undated screenshot or a general accusation of copying is insufficient.

Design infringement

For suspected design infringement, preserve the registered views, disputed product images, dates and supply evidence. Compare the protected appearance and assess applicable limitations. Court remedies require the proper legal route; a monitoring report is not an infringement judgment.

Official filing and support

This guidance concerns Turkish rights unless a section expressly names another jurisdiction. Kayra can coordinate research, document preparation and follow-up.
