Türkiye: practical decision and evidence

Design priority can connect a later filing to an earlier qualifying application within the relevant six-month period. Preserve the first application and verify identity of the design and applicant entitlement. A different variant cannot simply inherit every earlier priority claim.

Worked file: a second filing modifies a visible feature of the first design. Keep both submitted view sets and dates, and review whether priority is available for the same design and entitled applicant. Identify the changed matter instead of transferring the earlier date to the entire variant without analysis.

Applying for a design

Before a Turkish design filing, identify applicant and designer, prepare coherent reproductions, select the product classification and examine disclosure/priority dates. Submit through ePATS and keep the official receipt. A quote request to a consultancy is not the official application.

Design: twelve-month disclosure exception

For Turkish design protection, examine the twelve-month disclosure exception against the actual disclosure date, person and circumstances. Retain dated catalogues and launch records. Do not treat this exception as a safe worldwide filing strategy; other countries can apply different rules.

Deferring design publication

Design publication deferment is a filing-stage confidentiality choice subject to the applicable maximum period and office conditions. Schedule the eventual disclosure and required fees. Deferment does not extend the protection term or erase disclosure that already occurred elsewhere.

Official filing and support
