Design infringement

Türkiye: practical decision and evidence

For suspected design infringement, preserve the registered views, disputed product images, dates and supply evidence. Compare the protected appearance and assess applicable limitations. Court remedies require the proper legal route; a monitoring report is not an infringement judgment.

Worked file: the protected front view resembles a competing product, but side views differ. Preserve complete evidence and identify the relevant protected design, product and territory. Compare overall appearance and available limits with legal support; a similarity report should state its limits and cannot stand in for a court remedy.

Design representations

Prepare consistent views that disclose the same design and its relevant visible features. Explain omitted views and any excluded parts where required. Mixed colours, inconsistent shapes or unclear contours can leave the intended protection uncertain.

Design invalidity

Design invalidity asks whether a registered right satisfies the legal conditions for protection. Collect prior disclosures with dates and compare overall impressions. Distinguish an administrative publication opposition from a court invalidity action; a consultant does not decide validity.

Design monitoring

Monitor design publications and competing products through images, product names and Locarno classes. Keep dated captures and a comparison log. An alert is a reason to investigate; it neither proves infringement nor stops a competitor’s application automatically.

Official filing and support
