Türkiye: practical decision and evidence

Earlier rights can include names, trade names, copyright or relevant unregistered signs under the applicable ground. Preserve evidence showing entitlement and acquisition before the challenged filing. An unverified ownership assertion is not enough.

Worked file: the objector uses an artwork created by an external designer. Verify who owns the copyright, contract terms and date of creation/disclosure before relying on that right. Link the protected work to the challenged sign; possession of a file does not prove entitlement to oppose.

Relative trademark refusal grounds

Relative refusal grounds concern earlier rights and the statutory opposition conditions. Compare filing/priority dates, signs, goods/services and the claimant’s entitlement. A later party’s objection must still be supported by the relevant earlier right and evidence.

Opposition arguments and evidence

An opposition needs the application number, legal grounds, reasoned arguments and indexed evidence. Verify the official filing procedure, payment and receipt before the deadline. Sending documents to a consultant or by ordinary email is not necessarily a valid official opposition.

Bad-faith trademark opposition

For bad faith, build a chronology of prior relations, access to the sign, earlier dealings and the disputed filing. Explain what the evidence supports. Mere dislike of a competitor or similarity without context does not prove bad faith.
