Worked file: a product team wants “a patent search” before selling. Clarify whether the objective is novelty, patentability, technical landscape or freedom to operate. Select jurisdictions, technical features and date scope accordingly; an ordinary prior-art search does not prove freedom to commercialise the product.
Patentability conditions
Assess novelty, inventive step and industrial applicability separately using dated prior art and a feature comparison. Distinguish technical solutions from excluded subject matter. A working prototype or commercial success alone does not establish patentability.
Patent claims
Patent claims define the technical matter for which protection is sought. Link every feature to the original description and distinguish independent from dependent claims. Revisions must not introduce unsupported subject matter merely to avoid earlier art.
Patent search databases
Use TÜRKPATENT, Espacenet and PATENTSCOPE for complementary patent searches. Record publication/application numbers, families and search dates. Search databases are not interchangeable with the official national register for current legal status.
