Deferring design publication

Türkiye: practical decision and evidence

Design publication deferment is a filing-stage confidentiality choice subject to the applicable maximum period and office conditions. Schedule the eventual disclosure and required fees. Deferment does not extend the protection term or erase disclosure that already occurred elsewhere.

Worked file: the applicant asks to postpone publication after the product already appeared at a public fair. Preserve the fair record and filing-stage instructions, then check the available procedure and timing. Deferred publication concerns the office’s disclosure and cannot make an existing public launch confidential.

Confidentiality before patent filing

Before patent filing, control public presentations, offers, websites and disclosures to partners. Keep a dated disclosure chronology and signed confidentiality terms. A later confidentiality agreement cannot erase an earlier public disclosure; investigate the applicable country rules before relying on an exception.

Design representations

Prepare consistent views that disclose the same design and its relevant visible features. Explain omitted views and any excluded parts where required. Mixed colours, inconsistent shapes or unclear contours can leave the intended protection uncertain.

Design publication and opposition

A design publication must be checked against the filed views, design number and date. In Türkiye the publication opposition period is three months. Keep the bulletin and monitor notices; publication, opposition and renewal are distinct procedural events.

Official filing and support
