Türkiye: practical decision and evidence

A court action against a final YIDK decision is different from an administrative appeal within TÜRKPATENT. Preserve the decision, notification date and case file for qualified legal review. Sending another letter to the board does not necessarily preserve a judicial time limit.

Worked file: a final YIDK decision arrives and the client wants to send the same objection again. Preserve notification, decision and full evidence file, identify the available judicial route with counsel and calendar it properly. An internal instruction to a consultant does not preserve a court deadline.

Administrative appeal and YIDK

For an administrative appeal, identify the challenged office decision, notification date and applicable board route. Address the reasons in the decision and provide organised evidence. A final board decision may require a court route rather than another identical administrative filing.

Opposition arguments and evidence

An opposition needs the application number, legal grounds, reasoned arguments and indexed evidence. Verify the official filing procedure, payment and receipt before the deadline. Sending documents to a consultant or by ordinary email is not necessarily a valid official opposition.

Choosing opposition representation

Select opposition support by verifying representative registration, authority, conflicts and responsibility for the official deadline. Require a written scope and evidence plan. Court representation and administrative trademark representation should not be conflated.
