Türkiye: practical decision and evidence

For spare-part designs, separate visible appearance from dimensions required for mechanical connection or purely technical function. Record the product context and applicable territory. Do not promise protection for every replacement part without checking statutory exclusions and limitations.

Worked file: a replacement part must fit a standard connection but has independent visible ornamentation. Identify necessary fit features and the claimed appearance and assess local exceptions. Avoid promising the same protection for the mechanically mandatory interface and the freely designed visual portion.

Partial design protection

For a partial design, identify the visible part claimed and clearly distinguish the remainder. Make all views consistent with that choice and verify local representation practice. Ambiguous broken lines can be interpreted as decoration instead of excluded matter.

Design protection conditions

Design protection depends on novelty and individual character, considering the informed user’s overall impression and the designer’s freedom. Compare dated earlier appearances. Mere novelty in a product name does not establish a protectable appearance.

Design representations

Prepare consistent views that disclose the same design and its relevant visible features. Explain omitted views and any excluded parts where required. Mixed colours, inconsistent shapes or unclear contours can leave the intended protection uncertain.

Official filing and support
