When ATEX applies: intended function, location and justified exclusions

Check product function and actual scope before treating an outside location or a commercial label as an ATEX exclusion.

Physical location is not the only scope question

Directive 2014/34/EU covers specified safety, control and regulating devices intended outside potentially explosive atmospheres when they are necessary for, or contribute to, safe functioning of equipment/protective systems regarding explosion risks. Analyse the actual function and relationship to the protected equipment; outside placement is not by itself a reasoned exclusion.

For other products, establish intended use, product definition and any genuine legal exclusion. An exclusion under this directive does not remove other applicable product or workplace duties. Do not assign a group/category or protection type from an enclosure photograph, marketing phrase or the location of a sales office.

02

Hypothetical case: ordinary-location controller

A controller is marketed for an ordinary location but controls an explosion-protection function in an associated hazardous process. Its supplier claims ATEX cannot apply because the cabinet is outside the hazardous area. Obtain the function/interface description, failure implications, protected equipment relationship, operating conditions and intended-use statements.

Commission a competent scope assessment and record the supported reasoning. Determine whether the safety/control provision applies and what further product assessment follows. Neither the cabinet location nor a generic electrical test report resolves that function-dependent legal question; no category or zone is invented from this example.

03

Document the actual legal path

A supported scope record should identify the relevant provisions, supplied configuration, technical facts and remaining uncertainties. Where the directive applies, select the appropriate procedure before conformity claims. Exceptional authority authorisations have specific legal conditions; they are not a routine consultancy shortcut or evidence that emergency procedures are currently active.

Kayra can help assemble the function brief and questions to competent parties. It does not provide an authority exemption or unqualified guarantee that the controller may be used anywhere. The next action is a documented function-based scope decision and the corresponding evidence plan, with other applicable duties considered separately.
