01

Check the product’s actual legal scope

CE marking is required only where applicable harmonised EU product rules prescribe it. It must not be added to a product simply to strengthen advertising. Establish the intended use, characteristics and market, then compare them with the relevant legislation’s definitions, scope and exclusions. Other safety or market requirements can still apply when CE is not required.

Distinguish a product’s classification from the name chosen for its sales brochure. Different uses, functions or configurations can affect applicability, and several acts may apply together. Document unresolved questions and seek qualified technical or legal assessment rather than treating one standard number as a complete scope decision.

02

A hypothetical passive stand with an electrical option

A supplier sells a passive display stand and a separate version incorporating powered equipment. The customer demands a CE mark on every item. Obtain specifications for both versions and establish what each product actually does. Do not assume that the passive article falls under the same marking requirement solely because the versions share a catalogue.

Prepare a scope decision for each configuration and identify any other applicable product obligations. If the passive item has no relevant CE requirement, refuse to apply the logo merely for the customer’s convenience. For the powered version, determine the actual requirements and assessment route before planning evidence or marking.

03

A usable applicability record

Record the product description, relevant scope provisions, reasons for inclusion or exclusion and remaining questions. A useful conclusion identifies the basis and limitations; it does not claim exemption from every law. Revisit the decision when the product’s intended use, functionality or target market changes.

Kayra can help organise the scope information and preparation questions. A consultancy opinion does not bind the competent authority or guarantee market access. The manufacturer must establish the applicable requirements, obtain necessary specialist assessment and retain the evidence behind its decision to use, or not use, CE marking.
