01

An exclusion needs actual design facts

GAR addresses defined gas-burning appliance functions and relevant fittings. An appliance specifically designed for an industrial process carried out on industrial premises is excluded under the cited scope rule; its design must exclusively address that specific process/use. A commercial label or the customer’s factory address is not enough.

Other specified exclusions include aircraft/railway use and temporary laboratory research use. Establish the actual design and intended function rather than reading “industrial” as a universal exemption. Exclusion from GAR does not eliminate other applicable product, workplace or installation requirements, nor create an unrestricted permission to use the device.

02

Hypothetical case: standard heater installed inside a factory

A seller calls a standard space heater exempt because it will heat an office inside a manufacturing site. Obtain the heater’s design/use statements, marketed functions, installation instructions and the alleged process-specific requirement. Compare general space heating with a device exclusively designed for a particular industrial process.

Keep the exemption claim unaccepted until a competent scope assessment supports it. The premises alone do not explain why the design meets the exclusion. Do not invent a national exemption letter, change the product description to match a sales objective or assume unknown gas/pressure conditions.

03

A reasoned boundary and separate installation checks

Where GAR applies, plan the ordinary notified-body procedure and supported product evidence. Emergency derogations require specific activated legal conditions and competent-authority authorisation; they are not a normal consultancy shortcut. No current activation or permission for this hypothetical heater is asserted.

Kayra can organise the function brief and questions within agreed technical support. It cannot grant an authority exemption or approve the site connection. The next step is a recorded product-scope rationale, followed by the applicable conformity and competent installation tasks on their separate actual facts.
