When PED Applies: Thresholds, Exclusions and SEP
PED applicability is a scope decision, followed by a classification decision. A customer's request for 'CE certification' does not replace either decision.
Start with the actual scope
Article 1 concerns pressure equipment and assemblies with PS above 0.5 bar and lists exclusions. Identify the equipment's actual function, market and boundary. Simple pressure vessels governed by their specific directive, transport-related equipment and other listed exclusions require their own scope analysis rather than automatic PED treatment.
Distinguish being outside PED from being within Article 4(3) SEP. For in-scope equipment, Article 4 thresholds and the relevant equipment/fluid table determine whether essential safety requirements apply. An excluded product may have duties under other legislation; exclusion is not a general safety exemption.
Check a pipeline exclusion carefully
Hypothetically, a supplier argues that a pressure-reduction station's standard valve is exempt because it connects to a transport pipeline. Article 1's pipeline exclusion expressly does not cover standard pressure equipment such as equipment found in reduction or compression stations. Define the product boundary and check the valve's actual scope rather than copying the pipeline's exclusion.
Keep the clause and factual evidence used for each inclusion, exclusion or unresolved conclusion. A marketing term such as 'industrial component' cannot determine the result. Do not claim a category or SEP route when fluid, PS and applicable V or DN data remain unknown.
Apply the resulting obligations
Equipment under Article 4(3) is designed and manufactured according to sound engineering practice with adequate instructions and no CE under PED, without prejudice to other CE legislation. Equipment under essential safety requirements follows the applicable conformity route before marking and market placement.
A request to Kayra should include the scope evidence and precise activity; authority, permitted role and impartiality must be confirmed. This guide describes the EU/EEA route. For Türkiye market placement, verify the applicable current national implementing regulation separately; EU applicability is not an operational permit.
Questions for this purpose
Is SEP the same as exclusion from PED?
No. SEP is the Article 4(3) route for specified in-scope equipment below or at the applicable thresholds.
Can a pipeline exclusion cover every connected component?
No. Its terms include a specific exception for standard pressure equipment at stations.
Does no PED CE mean no safety obligations?
No. SEP instructions and other applicable legislation or use-stage duties still need consideration.
PED enquiry: scope and activity
State the product boundary and the claimed inclusion or exclusion clause. Supply PS, fluid, temperature and applicable dimensional data so the scope decision can be evidenced.
