Response to trademark opposition: applicant’s file
Use this service when you are the applicant responding to an opposition notified in a Turkish trademark file.
Service purpose and initial file
Use this service when you are the applicant responding to an opposition notified in a Turkish trademark file. Obtain the actual notice, grounds, cited rights, exact application and goods or services list. Record the response event and requirements from the official file; do not treat a response as a new opposition against your own application. Identify whether any request concerning proof of use or another procedural issue needs qualified assessment in the particular case.
Preparation and next action
Organise the response by material ground and connect each factual statement to a relevant record. Compare the signs and actual goods or services rather than deciding from colour, a company name or a class number alone. Identify disputed facts and missing evidence before approving the response. Confirm the authorised procedural owner and current response requirements. Keep the approved version and official submission evidence together; an email with attachments to a consultant does not demonstrate that the office received a response.
Hypothetical initial-file decision
In a hypothetical notice, the opponent raises both likelihood of confusion and an earlier right in the logo. The applicant supplies a different colour version and asks to answer only the confusion argument. Separate the two grounds, check the actual applied-for sign and obtain creation or permission records relevant to the alleged earlier right. Do not imply that changing a draft image disposes of every ground or automatically changes the filed application. Decide which records and qualified advice are needed for the response actually served.
