Choosing Nice classes

Choose Nice classes from a concrete list of products and services, using the official accepted wording. Check both present activity and planned lawful expansion. Class numbers alone do not describe the full scope and different classes can still contain similar services.

Classification case: a business producing packaged coffee and selling it in its own store requests only class 35. Describe coffee as goods. Selling goods alone is not a service for classification purposes; separately assess any actual retail service bringing goods together for others so customers can view and purchase them, and check accepted Turkish wording. Check both class numbers and accepted wording. Compare nature, purpose and commercial channels: the same number does not automatically prove similarity and different numbers do not automatically establish separation.

02

Nice class 35

Nice class 35 concerns services such as business and specified retail activities; it does not replace protection for the goods themselves. Describe the actual retail service and goods being brought together. A shop selling its own branded products may need additional goods classes.

03

Similarity of goods and services

Compare goods/services by nature, purpose, users, distribution channels and their complementary or competing relationship. Explain the connection with the actual wording. Identical class numbers do not automatically prove similarity, and different numbers do not rule it out.

04

What trademark registration protects

A trademark distinguishes goods or services and is registered for a defined sign and scope. Choose the owner and wording from actual business activity. Registering a company name or website alone does not obtain trademark registration for every product.

05

Word mark or logo

Choose a word mark when the sign sought is the wording, and a figurative filing when the intended sign includes its visual composition. Compare actual use and planned logo changes. Registering one version does not mean every future redesign has the same scope.

06

Trademark application documents

For a trademark file, prepare applicant identity, the exact sign, goods/services and official fee information. Add priority, consent, transliteration or representation documents when applicable. A generic company profile alone is not the complete trademark application.

07

Applying for a trademark

Before a Turkish trademark filing, identify the owner, exact sign and actual goods/services, then check earlier rights. Submit the correct ePATS application and official payment information. A domain purchase or company incorporation does not replace trademark registration.

08

Official filing and support

This guidance concerns Turkish rights unless a section expressly names another jurisdiction. Kayra can coordinate research, document preparation and follow-up. Registration, opposition and grant decisions belong to the competent office. Verify any required representative’s registration and authority before appointing them; court proceedings require appropriately qualified legal representation. The enquiry form requests consultancy, and does not itself file an official application.
