EU trade mark through EUIPO

An EU trade mark is handled by EUIPO and concerns EU territory; Turkish registration is not converted automatically. Review earlier rights, the goods/services wording and the filing route. A single EU application can still face objections and opposition.

Market case: sales in Europe begin under a Turkish trademark and one document is assumed to protect every target country. Compare EU and relevant national/international routes against the owner and goods/services list. Plan clearance, local examination and notice handling for each target. Verify the concrete registers behind a “worldwide monitoring” promise before presenting it as full territorial protection.

02

International trademark monitoring

International trademark monitoring must specify target countries and cover their relevant national and Madrid records. Record publication dates and local action windows. Watching only the Turkish bulletin cannot provide complete foreign-market monitoring.

03

Choosing Nice classes

Choose Nice classes from a concrete list of products and services, using the official accepted wording. Check both present activity and planned lawful expansion. Class numbers alone do not describe the full scope and different classes can still contain similar services.

04

Trademark clearance search

Search identical signs, spelling and pronunciation variants and relevant earlier marks in the target market. Record search dates and goods/services. No-result searches reduce information gaps but cannot guarantee that the proposed sign will be accepted.

05

Individual or company ownership

Choose the applicant according to the intended legal owner, not convenience alone. Record individual or company identity and any assignment arrangements. A shareholder and the company are different persons; rights held personally are not automatically company assets.

06

Trademark portfolio management

Reconcile trademark portfolios by owner, sign, goods/services, territories, renewal dates and use evidence. Link every licence and transfer to the relevant registration. A domain, trade name and registered trademark are separate assets and need separate records.

07

Trademark monitoring service

Define a trademark-monitoring service by territories, signs, classes, frequency and responsibility for escalation. Review the written coverage and sample reporting. Monitoring does not automatically file an opposition or guarantee that every conflicting application will be found.

Official filing and support

This guidance concerns Turkish rights unless a section expressly names another jurisdiction. Kayra can coordinate research, document preparation and follow-up. Registration, opposition and grant decisions belong to the competent office. Verify any required representative’s registration and authority before appointing them; court proceedings require appropriately qualified legal representation. The enquiry form requests consultancy, and does not itself file an official application.
