PPE: When the Regulation Applies and Which Conditions Matter
Scope depends on the actual product and activity. A free supply or an urgent order is not automatically outside the conformity rules.
Establish product and market scope
Regulation 2016/425 concerns PPE made available on the Union market, including supplies in commercial activity whether paid or free. Check the actual worn/held protection, relevant components/connection systems and Article 2 exclusions. Do not infer an exemption from a local product nickname or a buyer's price.
Where applicable, classify the risk under Annex I and select Article 19's route. Separate product conformity from workplace selection/use duties and from non-PPE legislation. Do not classify a protective item without knowing the intended risk and conditions.
Case: protective equipment in a free promotion
Hypothetically, a business gives protective gloves to customers free of charge and calls the supply a marketing sample. Establish the commercial supply, intended protection and applicable product duties before distribution. Payment is not the decisive scope criterion; a label saying sample does not supply missing conformity evidence.
A trade-fair display of noncompliant PPE has specific visible-notice and protection conditions and is not permission for general market supply. Obtain the relevant evidence and responsible decision before converting a display into a delivery.
Do not assume an emergency shortcut
The consolidated May 2026 text includes Articles 41a–41e. Their use depends on Commission activation, designated crisis-relevant PPE and the applicable emergency conditions; ordinary urgency does not activate them. Any specific authorised derogation has its own scope and marking conditions, not a consultant-granted CE exemption.
For Kayra, state the product, market and requested activity; verify authority, permitted scope and impartiality before acceptance. This guide does not establish an active emergency authorisation, product approval or body appointment.
Questions for this purpose
Does free commercial supply remove PPE duties?
No. Making available can include commercial supplies without payment.
Is display at a trade fair the same as general delivery?
No. The specific display conditions do not authorise ordinary market supply.
Does a rush order activate the 2026 emergency procedures?
No. Applicable activation, product designation and authorisation conditions must exist.
