FDA status is category-specific
For medical devices, FDA explicitly says establishment registration and device listing do not establish approval, clearance or authorisation. Match any status evidence to the actual manufacturer, model and intended use; identify the applicable market-entry pathway rather than describing registration as approval.
Hypothetical case: registered does not mean approved
A supplier advertises a device as “FDA approved” using only registration/listing evidence. Ask for the actual model-specific basis before accepting that statement. If the same exporter wants a US trademark, review domicile and the applicable USPTO stage separately, including the Madrid initial-transmission exception.
Prepare records for the right professional
Send device use, specifications and available FDA records; for a trademark send owner/domicile details and the goods/services brief. Foreign-domiciled trademark applicants generally need US-licensed counsel. Kayra is not presented here as US counsel or as authorised to prepare and file USPTO submissions for others.
Preparation and decision limits
