Who handles EMC: manufacturer, examiner and surveillance authority
Allocate actual apparatus and fixed-installation roles without treating laboratory evidence as a public approval.
Separate decision makers and technical inputs
The apparatus manufacturer establishes conformity through the selected Article14 route, prepares the file and declaration, and keeps production consistent. A laboratory supplies defined technical evidence. If AnnexIII is chosen, an appropriately notified body examines the design within the requested aspects, followed by the required conformity-to-type work; its involvement does not erase manufacturer responsibility.
An importer or distributor becomes the manufacturer when placing apparatus under its own name or mark, or modifying it so that conformity may be affected. Contract wording cannot remove that statutory role. Fixed installations separately require identification of the person responsible for their conformity and operational-lifetime engineering documentation.
Hypothetical case: own-brand industrial interface module
An importer sells a wired industrial interface module under its own brand and adds interface options. It points to the factory’s declaration and a consultant’s invoice as the responsible issuer. Identify the actual manufacturer, models, interface revisions, applicable route, supporting file and the authorised person signing the declaration.
Determine access to design and configuration evidence and who reviews the added options. The factory’s records may be useful, but the own-brand role and conformity-affecting changes need their own supported treatment. Do not transfer the decision to a consultant merely because it organised testing or prepared draft documents.
Responsibility and escalation record
Record who performs technical work, controls documentation, signs the declaration, maintains production and handles corrective measures. Verify a chosen examiner’s actual designation/task rather than relying on a logo. Public authorities retain implementation and enforcement roles; a laboratory result is neither a market-surveillance decision nor universal permission for all model variants.
Kayra can assist with the role map and evidence coordination. It does not claim statutory EMC examiner or authority status. The next step is a named responsibility/record-access matrix and technical review of the marketed configuration, with any unresolved conformity claim kept separate from commercial handover.
