Who is responsible for LVD: manufacturer, importer and laboratory
Identify the actual declaring manufacturer and supply-chain duties; an LVD laboratory report does not transfer responsibility to a consultant.
Allocate the legal roles
LVD conformity assessment and the declaration are the manufacturer’s responsibility. A laboratory can perform defined examinations and issue results; consultancy can help organise evidence. Neither service creates a notified-body approval role under LVD. Identify the legal party marketing the equipment under its name or trade mark before assigning file and declaration tasks.
Importers and distributors have their own checks and traceability duties. An importer or distributor using its own name or trade mark, or making a modification that may affect conformity, is treated as a manufacturer under Article 10. A private contract can allocate practical work but cannot erase the legal duties arising from the actual role.
Hypothetical case: an own-brand desk fan
An importer sells a 230 V desk fan under its own brand, while the file and declaration name the overseas factory. The purchase agreement says the factory accepts all CE responsibility. Compare the product label, brand arrangement, declaration, technical-file access and the actual legal manufacturer role; the contract statement does not resolve their inconsistency.
Determine which party must fulfil the manufacturer obligations and correct the evidence and declaration through the responsible people. Do not simply replace the factory name on a PDF without establishing file access, design knowledge and conformity responsibility. A laboratory report may support the assessment but cannot decide who the legal manufacturer is.
Make responsibilities operational
Name the people controlling drawings, approving changes, maintaining production conformity, signing under the correct authority and responding to market-surveillance requests. An authorised representative needs a defined written mandate; the manufacturer’s design/manufacture duty and duty to establish technical documentation cannot be treated as generally transferred to that representative.
Kayra can coordinate the responsibility matrix and record questions within its consultancy scope. It is not automatically the manufacturer’s representative or signatory. The next action is a role-and-access review of the actual transaction, followed by a controlled correction of inconsistent names and permissions before market release.
