Who is responsible for machinery CE marking and assessment?
Identify manufacturer, authorised representative, notified body and market-surveillance roles without treating CE as a centrally issued certificate.
The manufacturer’s declaration and marking
For complete machinery under Directive 2006/42/EC, the manufacturer or its authorised representative fulfils Article 5 obligations, selects the appropriate assessment route, draws up the EC declaration and affixes CE marking. There is no universal authority that sells or registers every machinery CE certificate.
The authorised representative requires a written mandate and establishment in the EU as defined by the Directive. A consultant’s engagement or a contact address does not create that status. Identify the actual manufacturer rather than assuming the supplier’s trade name resolves responsibility.
A notified body’s limited assessment role
A notified body examines or approves only the procedure and machinery categories for which it is notified. Check its NANDO entry and the certificate’s identified type and conditions. Accreditation, a laboratory report and notified status are different evidence.
A hypothetical distributor rebrands a machine and supplies a declaration bearing the original factory’s name, although the responsible operator and configuration are unclear. Resolve the manufacturer role and actual conformity evidence; buying a separate “CE certificate” does not fix that inconsistency.
Public authorities and technical preparation
National market-surveillance authorities investigate conformity and safety and can require corrective measures. Their powers are not transferred to a notified body or Kayra. A buyer’s acceptance is also separate from compliance with the applicable legislation.
Kayra can provide agreed product-scope and technical-file preparation support and coordinate external steps. No Kayra notification, authority mandate or universal certificate-issuing power is asserted here. For supply from 20 January 2027, recheck the Regulation’s manufacturer and importer duties.
