PPE: Manufacturer, Notified Body and Decision Roles
There is no single actor issuing every document called a PPE certificate. Identify the legal duty and output first.
Assign duties to actual legal entities
The manufacturer designs and manufactures compliant PPE, draws up the technical file, arranges the applicable procedure, issues the EU declaration and maintains series conformity. Importers and distributors have their own checks and corrective duties; a supplier invoice does not allocate all these responsibilities.
Article 12 can treat an importer or distributor as manufacturer when it markets PPE under its own name or trademark or modifies it so conformity may be affected. Identify the actual entity, signatory, product configuration and file access, rather than relying on a trade name.
Case: own-brand helmet and a changed accessory
Hypothetically, an importer replaces the original helmet brand with its own and adds a mounting accessory. Do not assume the original declaration simply transfers. Establish the manufacturer duties, effect on protection and compatibility, and the applicable assessment before release; preserve genuine links to the underlying type and production evidence.
A notified body issues the applicable type-examination or production-stage output only within its legal designation. Check the exact PPE tasks through official resources. A generic accreditation certificate, logo or number is not evidence of every PPE appointment.
Check the requested role before agreement
Article 24 requires independent notified assessment and prohibits conflicting direct design and consultancy activities. Scope and actual functions matter; separate invoices alone do not establish independence. Laboratory evidence, manufacturer declaration and body decision are distinct.
For Kayra, describe the requested activity and verify authority, permitted scope and impartiality. This guide does not establish a PPE notification or transfer the manufacturer’s responsibilities. Require a named decision holder and a written scope.
